Who will compensate for nine-and-a-half years lost by innocent devout Hindus ? – questions Sanatan Sanstha

Kolhapur – In the Comrade Govind Pansare murder case, the Kolhapur bench of the Bombay High Court has granted bail to devout Hindus Dr. Virendrasingh Tawde, Mr. Amol Kale and Mr. Sharad Kalaskar. This decision by Justice Shivkumar Dige has paved the way for Dr. Tawde’s release after a prolonged legal battle of 9 years and 6 months.

Against this backdrop, Sanatan Sanstha spokesperson Mr. Abhay Vartak said, “Earlier, the Kolhapur Bar Council refused to provide a lawyer to the defense, and now communists have exerted pressure to cancel the bail, overall, the ‘pressure groups’ of progressives and communists show how the lives of innocents are ruined. A gold medalist ENT surgeon had to remain in prison for 9 years; this is a heartrending example. Who will compensate for the precious years of their lives that have been wasted ?” He raised this question. “On the eve of Diwali, the Hindu society has received joyful news. Recently, devout Hindus in the Malegaon case were acquitted, and now in the Pansare case all devout Hindu individuals have received bail. Therefore, in the true sense, this year devout Hindus will celebrate Diwali,” Mr. Vartak added.

Elaborating on the sequence of events, Mr. Vartak said, “In January 2018, the Kolhapur Sessions Court granted bail to Dr. Tawde in the Pansare case; however, he was not released as he was in custody in the Dabholkar case. On May 10, 2024, as soon as he was acquitted in the Dabholkar case, the Pansare family and communist forces launched a campaign to get the bail cancelled. Subsequently, after the bail was cancelled, he had to return to prison. Now, with the High Court’s decision, he has finally received justice.”

Appearing for the defense in the Bombay High Court was Senior Advocate Nitin Pradhan, while at the Kolhapur bench, Hindu Vidhidnya Parishad President Adv. Virendra Ichalkaranjikar and Adv. Siddhavidya argued. They submitted that the testimony of prosecution witness Sagar Lakhe was recorded three-and-a-half years after the murder. After bail was granted in 2018, the State’s appeal in the High Court was, on its own, withdrawn in 2023. Further, since six other co-accused in the same case had been granted bail, the principle of parity warranted bail for the remaining accused as well. In the same hearing, former Judge and Advocate Pushpa Ganediwala presented an effective argument on behalf of other innocent devout Hindus, Mr. Amol Kale and Mr. Sharad Kalaskar. On behalf of the entire Hindu society, Sanatan Sanstha heartily congratulates all these advocates for their successful efforts.

“Justice delayed is justice denied”, this judicial maxim applies precisely to Dr. Tawde, Mr. Kale and Mr. Kalaskar. Those who obstructed due process and caused this delay should face action. With this bail, half the battle has been won; with God’s grace, their full acquittal will come soon, bringing complete success, we repose such faith unto the ‘Nyayadevta’,” Mr. Vartak stated.
